Terms of Service

These Terms of Service govern your use of the Couple Baby Generator mobile application, operated by Lilian Mercado (lilianmercado.xyz). The app is also subject to Apple's standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

1. Acceptance of Terms

By downloading, purchasing, installing, or using the Couple Baby Generator application ("App", "Service"), you agree to these Terms of Service. These Terms form a binding legal agreement between you and Lilian Mercado ("we", "us", "our"). You must be at least 18 years of age to use this application.

2. Description of the Service

Couple Baby Generator uses artificial intelligence to generate fictional baby images from photographs of two individuals provided by the user. The app offers two generation modes (a combined couple photo or two separate photos), customization of traits such as eye color, hair color and age stage, twins and triplets generation, a private in-app gallery, and a pregnancy due-date countdown. All generated images are fictional AI creations for entertainment purposes only and do not predict the actual appearance of any real child.

3. Subscriptions, Payment, and Refunds

Baby generation requires a Premium auto-renewable subscription: Weekly ($2.99), Monthly ($8.99), or Yearly ($39.99, including a 1-week free trial). Prices may vary by region. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your App Store account settings. All payments are processed by Apple; refunds are governed by Apple's refund policies and must be requested through Apple.

4. Acceptable Use

You agree to use the Service only with photos you have the right to use. You must not upload photos of any person without their consent, photos of minors, or unlawful, offensive, or infringing content, and you must not use generated images to harass, defame, deceive, or impersonate any person, or present them as genuine photographs of a real child.

5. Intellectual Property

The application, its design, user interface, branding, and underlying technology are the exclusive property of Lilian Mercado and are protected by applicable intellectual property laws. You retain all rights to the photos you upload and are granted full personal-use rights to the images generated for you. We create no biometric templates or face measurements from your photos.

6. Privacy

Our handling of your data, including uploaded photos and face data, is described in the Privacy Policy. In short: uploaded photos are used solely to generate your images and are automatically deleted from our storage as soon as your generation completes.

7. Generation Quality and Availability

AI-generated results vary and no particular quality, likeness, or outcome is guaranteed. The Service depends on third-party AI infrastructure and may be temporarily unavailable, rate-limited, or modified. We reserve the right to apply fair-use processing limits.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GENERATED IMAGES ARE FICTIONAL AND FOR ENTERTAINMENT ONLY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF THIS SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend and hold harmless Lilian Mercado from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the Service, or your upload of photos you were not entitled to use.

11. Termination

We may suspend or terminate access to the Service for violations of these Terms, including uploading prohibited content. You may stop using the Service at any time; deleting the app removes all locally stored images.

12. Changes to the App and Terms

We may update the app and these Terms from time to time. Material changes will be announced in-app. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
